Rosalyn Burt Joins Better Homes and Gardens

Bushkill – Rosalyn Burt, Salesperson has joined the Better Homes and Gardens organization as a full-time Realtor.  Burt is originally from Doylestown and has lived in the Poconos for the past 15 years.

Burt is a member of The Falls community association Board of Directors.

Burt has been in the real estate industry since 1983.  Her real estate career began in Toms River, New Jersey as a mortgage closer, as a real estate review secretary with the Honorable Francis P. Piscal, a real estate secretary for the law firm of Orlovsky, Grasso & Bolger and in the title business as an administrator from 2000 to 2006.

Burt was recruited by Dennis Mooney, V.P./Sales Manager.

Wilkins “Family” Accepts Applause

Swiftwater -  The Wilkins organization which includes Better Homes and Gardens Real Estate Wilkins & Associates, Wilkins & Associates—PROPERTY MANAGEMENT, NEPA Management Associates, Pennsylvania First Settlement Services and Wilkins & Associates Commercial Brokers celebrated at The Garden at Desaki on June 20, 2013.  The party was to commemorate 25 years in business—2013 of the real estate and management companies.  Pennsylvania First Settlement Services was an addition to the Wilkins organization approximately 12 years ago.

The gala was attended by not only the Wilkins family, but senior management, Realtors, staff, selected guests including Rosemary Brown, State Representative, Mario Scavello, State Representative, Board of Director members of the approximately 30 associations managed by the Wilkins organization and other select guests.  Total attendance exceeded 100 persons.

The party, hosted by Desaki, featured a 10 minute video produced by George Roberts Productions which accented the beginning roots of Wilkins where Tom Wilkins bought the company from family members, the transition of the company throughout two (2) downturns in the Pocono market place, to where they are today as a leader in the northeast Pennsylvania real estate industry that includes sales, rentals, property management, maintenance and handyman services and other professional courtesies for the real estate industry that they perform on a daily basis.

Thomas R. Wilkins, CEO, was presented a plaque honoring the event given to him by Christine A. Wilkins, wife and General Manager.  In addition, Wilkins, with his family and Managers on stage, received applause from those in attendance acknowledging the celebration and being a part of it.

Three Leading Realtors Unite With Better Homes and Gardens Wilkins & Associates

Stroudsburg - Christine A. Scrofano-Wilkins, Senior Vice President proudly announced the hiring of Sharon Lightfoot-Wade, Realtor; Charlotte Ashworth, Realtor and Gene Meisenhelder, Realtor. All three will work from the Stroudsburg office. Lightfoot-Wade, a full-time Realtor for the past 25 years, had, in early August, the pleasure of traveling to Parsippany, NJ for a personalized tour of the Better Homes and Gardens Real Estate corporate office.

Lightfoot-Wade had worked for other franchise brokers before, but the Better Homes and Gardens online platform was a major attraction to her. Lightfoot-Wade provides online marketing for buyers and sellers throughout the Pocono Mountains region.

Ashworth, formerly of Realty World, had been with the Wilkins Company previously when they were not affiliated with the BHG brand. Ashworth, who along with Lightfoot-Wade, accompanied Thomas R. Wilkins and Tommy Wilkins to Corporate Headquarters, echoed the same excitement. "The online tools available in the Greenhouse are simply head and shoulders above any other franchised Realtor. When coupled with the Wilkins' family's ability to market Pocono real estate, it was simply the only decision I could make." said Ashworth. Ashworth has been licensed by the Commonwealth of Pennsylvania for over 15 years and had lived in Texas prior to moving to the Poconos.

Meisenhelder, a former full-time Realtor with the Wilkins organization, is a lifetime resident of the Pocono Mountains. He resides in Stroudsburg with his wife and two children. A graduate from ESU with a degree in Economics, Meisenhelder practiced real estate between 2004 and 2006. Meisenhelder won a number of awards including Rookie of the Year in 2004. With the downturn in the market, he was not in real estate but instead had a corporate manager's position between 2009 and 2012. Seeing the Pocono real estate market improving, he is excited to again be with the Wilkins organization.

Nittany Court hires Wilkins & Associates Property Management for finance and bookkeeping


Mount Pocono - Nittany Court hired Wilkins & Associates PROPERTY MANAGEMENT to provide finance and bookkeeping services for their community located in the Borough of Mount Pocono 

The Association consists of 24 townhomes and is primarily owner occupied.  The Community was developed in the mid-1990s by Richard Mears and subsequently sold by Robert Nahudil.  Wilkins & Associates was the listing and selling Broker.  Thomas R. Wilkins marketed the project as one of the first projects in which a Broker was a "partner". 

While not providing full property management services, Wilkins & Associates is contracted by the Board to collect the dues, late fees, interest charges and assessments, deposit that money into the bank, record the transaction to the proper owner and reconcile that income.  Wilkins then reports the income and expense to the Board of Directors and Treasurer on a monthly basis.

Said Thomas R. Wilkins, CEO, "In the old days the volunteer position of Treasurer was not hard to fill, but in today's market place, no one wants to spend the amount of time that it takes to provide financial services to the Association nor do they want the responsibility or liability of handling any sort of money.  We do it for a living which is why we have a sincere interest in providing these type bookkeeping and accounting services."

Better Homes and Gardens Wilkins & Assocs Fight Pocono Mt Christmas Hunger

Stroudsburg/Bushkill/Mt. Pocono - Better Homes and Gardens Real Estate Wilkins & Associates has been helping the Pocono community for close to 25 years. This year, the Realtors, Managers, Supervisors and employees unanimously agreed to support three fine food banks and pantries in the Poconos. Through the efforts of Marilyn Lesoine, Administrative Assistant, food was dropped off to the Mount Pocono Hunger Ministry; The Bushkill Outreach Program will receive food from Dennis Mooney, Vice Pres./Sales Manager and Lori Lehman, a sales representative with Pennsylvania First Settlement Services will accept the third $300 donation towards turkeys and fresh vegetables for her organization to use at a Christmas eve dinner for the needy in East Stroudsburg.

All of this was accomplished through "Casual for a Cause" in which the Realtors, employees and Supervisors are able to wear blue jeans or casual clothes to work. For that privilege they pay $5.00 per day. Said Rosemarie Lobe-Waller, CFO, "It's not really the $5.00, we all like to wear jeans, but it's knowing that at the end of the year, we have our Sunshine Fund filled with money so we can do these type give-backs to our community. Waller has been with the company for 10 years.

The giving of food took precedence over presents for families this year because all of the good people with the Wilkins organization felt that supporting the food ministries was much more important.

WILKINS REAL ESTATE HIRES MELNICK AS SALES PERSON

Stroudsburg - Melanie Melnick, Realtor, has joined Better Homes and Gardens Real Estate Wilkins & Associates as a Salesperson in their Stroudsburg office. Melnick took the required courses and passed the examination to receive her Pennsylvania Salesperson's license. Melnick attended the Pocono Real Estate Academy.


Over the years, Melnick has accumulated 20 plus years experience in sales, primarily in the food industry, most of which were in management positions.

Said Dennis Mooney, Company Recruiter, "Melanie scored extremely high in the Simulator test that we ask all our new perspective agents to take. It's a service we subscribe to and the Simulator really gives us an assessment into the applicant's sales skills, assessing their knowledge and also a personality assessment illustrating the prospects' characteristics as compared to successful real estate agents."

The Wilkins organization also has free in-house training that covers such areas as Listings, the Agreement of Sale, Rentals, Internet Marketing and other one-on-one courses to teach conduct and salesmanship.

Melnick is originally from Long Island, New York, lives in Blue Mountain Lake Estates and has lived in the Poconos for the past 6+ years.

THE LAW AND YOU - LANDLORD AND TENANTS
Part 3 of 3

Landlord Filing Against Tenant

In my last blog I told you how a tenant can file against a landlord. This blog will discuss how a landlord can file. As with this entire series, this is not legal advice, simply an overview of what happens at the magistrate courts through our experience as a property management company.

As a landlord, there are three specific items that you need to be aware of. The first is that you must give the tenant a Notice to Pay Rent or Quit. This can be served either in person, by posting or by regular or certified mail. It "sets the stage" for the rest of your filing. In that Pay Rent or Quit (there are a number of forms that you can find online which will show you a sample Pay Rent or Quit) it must state the number of days you give the tenant to make good on the rent. At NEPA Management Associates, we typically, we use five (5) days. Beware of leases in which the landlord claims that the tenant waives the right to notice; they do not holdup in the Pocono magistrate system.

The second piece of mail that is then delivered to the tenant is a 10-day Notice. That notice is (1) sent via certified mail; (2) sent by regular mail; (3) and posted or hand-delivered to the tenant. While some courts require all three of these delivery methods, you're safest to do all three as opposed to doing only two or one of the three methods. Pocono magistrate courts like to see ample delivery.

If you do not do this, you run the risk that the filing may be thrown out and you need to start over again.

You will then receive a hearing date from the magistrate court. You must attend that hearing. If the tenant pays in full prior to the hearing date, you can dismiss the case. If they pay a partial rent, do not discontinue the filing; simply adjust the amounts due when you get to court. Since it is a landlord/tenant action, you must attend; you cannot simply file and let the court do all the work, like when you file a judgment.

At NEPA Management Associates, we like to add one month's rent to the filing assuming that the case maybe continued or not promptly heard by the court. That way, you're not going in and filing simply on past rent, but it should make you current with the rent that is due. That's an office policy and I am not sure that it is something that we would advise people outside of our office to do.

At the hearing you need to show the judge (1) of the fully executed lease; (2) copies of the tenants' ledger which show what payments have and have not been made and (3) any and all documents that you have sent to the tenant regarding the non-payment of rent. Don't try to skip any of these steps; it's essential that you prove your case.

If you have all of this information, then you should be successful at court. The judge will give the tenant two options on which they may appeal. They can appeal the court's decision for possession within 10 days or for the monetary decision within 30 days. Nothing can be done during the appeal time period.

After the appeal period, then you can "re-file" at the magisterial court for possession of the unit in the event they have not done that. That will require additional funds to be paid and it will have the sheriff go out and physically evict the tenant from the property. Hopefully, the tenant will have left prior to that and you don't need to go through the final act of the eviction.

On the Web
There are a number of sites available that give you more information and copies of the various forms to notify a tenant of a delinquency. The actual filing form you can get from the magisterial court. Remember, court is in that district that's closest to where the unit is located. Any of the sites will give you the documentation that you'll need.

You can use a Management company to perform this service for you; at NEPA Management Associates we handle such cases whether we represent you in collecting your rent or not. You must simply have to provide us the proper documentation that we need to be successful at court. Our track record is probably close to 90%+. We pride ourselves on being good at what we do.

Well, that's how you file against a tenant who doesn't pay rent. One thing to remember, the key to having a good tenant comes really in the very beginning. If you have a tenant that has good credit, good housekeeping, and good references, has been at their job for 2 years or longer, the risk that you run of them becoming delinquent is drastically reduced. It's all in the application.

I've been a landlord for close to 40 years now and absolutely love it. Once real estate investing and income properties get into your blood… it's hard to get out.

IS TITLE INSURANCE REALLY BORING?

Stroudsburg--When we first talked about this blog, I was warned by Lorie Lehman who is an Account Manager at Pennsylvania First Settlement Services located here in the Pocono Mts that it would be very hard to write a blog about title insurance because… there's just not a lot to say! I thought about that long and hard and you know what, maybe she has a good point, but since title insurance is required on every real estate transaction, it's got to be something that's worthwhile talking about. So, I'm giving it a try.

I elected to talk about title insurance from three viewpoints; (1) the buyer; (2) the Realtors--primary contact of a transaction and (3) an owners of the title company. Each of these people make up a title insurance transaction and each of them are important in the actual transaction itself.

The Buyer's Role
The buyer is actually the purchaser of the title insurance policy. All transactions (that are mortgaged) require that the property be insured at minimum in the amount that it is mortgaged. In my professional opinion, title insurance should be in the amount of the value of the property as opposed to the value of the mortgage, but 9 times out of 10, it's for the mortgage amount.

What is title insurance?..."Title" is the foundation of ownership of a property. Title to a property collectively makes up the terms that are your legal rights to own, possess, use, control and dispose of property. Title insurance is an insurance policy that protects against future loss should a title condition be any different than when the policy was written.

A title deficiency is something that's missing from the title; for example, an undisclosed error from a previous owner who could make a claim on the property. It includes anything that could happen with the entire ownership of the piece of real estate that may encumber or jeopardize the owner's rights to a "peaceful enjoyment" of the property or cause the owner to lose any portion of the parcel.

An encumbrance is a claim made upon the land. For instance, your local power company may have an easement for a power line that will serve your home. If you are borrowing money to purchase land, your lender will require your title to be cleared of any outstanding deficiencies or encumbrances before the land transferred or, at minimum, clearly identified.

The biggest question is…why do I need title insurance? You as the land owner are protected against any title loss. Title insurance insures the value of the property. Having clear title is something that will be required when you go to sell the property, because the buyer is going to want title insurance and if you don't have it, you have risk in reselling of your investment.

Title insurance comes after a title search. A title search is a detailed examination of the historic and public records concerning the property. Those records, including the deeds, court records, property name and indexes and many other public documents are reviewed by the Title Searcher. The purpose of the search is to verify the seller's right to the transfer of ownership and to discover any deficiencies or encumbrances on the title that have not been disclosed to you the buyer.

You may ask, is title insurance as important as other types of insurances such as fire, and homeowners? The answer to that is, yes. Because your losses without title insurance can even be greater than that of a fire or homeowner loss, title insurance is just as important, if not more important than those other types of insurances. For example, imagine if a house burns down, the land is still there on which to rebuild, but if there are title problems, then not even the land has a value.

Last but not least, does title insurance protect both me and my heirs? Yes, the title insurance policy covers from the time of its effective date back to the origin of title. If the property passes to your heirs or devisees the title insurance policy would defend the title for your heirs and devisees just as if it were for you when you were alive.

Title insurance is ordered after the Agreement of Sale is executed by all parties. It is typically handled by the Realtor who suggests the title company and forwards a copy of the Agreement of Sale including the terms and conditions thereof to the title company. The title company then represents the buyer in the transaction and provides for title insurance and settlement services to transfer the property from the seller to the buyer. It's called a closing.


The Realtor's Role
The Realtor's role in a property transaction is that of a conduit to get the fully executed Agreement of Sale to the title company. The Realtor also will help the title insurance company get to know who the buyer is, all their contact information, provide the Agreement of Sale (and any contingencies thereof) and give the title company the proposed settlement date.

Realtors look for customer services such as timeliness, accuracy, courtesies and doing all that above being done with a smile!

Until the time the property deed is searched, the Realtor doesn't have a lot to do with the transaction. The Realtor is typically involved in the property inspections, mortgage contingencies and other contingencies that may be required for the sale.

After all of the inspections are done, then the Realtor becomes involved in the title insurance part because the transaction is now getting ready to close. The Realtor will find out on behalf of the buyer, whether the title search has been done--we talked about a title searcher earlier. Everyone begins to zero in on the date and time that the settlement will occur.

A few days before closing, a draft HUD is forwarded between the seller's Realtor, the buyer's Realtor and the buyers themselves. Each party will review the HUD to ensure that the correct pro-rates are taken care of and displayed properly on the HUD. Usually that takes a few times going back and forth to make sure all the numbers are properly recorded in the right places. After that, a final HUD is issued and the buyer's told exactly how much money they need to bring to closing.

At settlement, it's usually a pretty good time! The buyer is excited to buy and the seller is excited to sell. The Realtors are…excited to get paid their commissions for a successful transaction.

The settlement process will usually take about 45 minutes to 1 hour maximum. It's the time where the keys are exchanged, the mortgage documents are reviewed by either the mortgage broker or the settlement officer and checks are traded between all of the parties. At that point, the buyer owns a new home and gets the keys to the property.

Title Company Owners' Role
A person or persons own(s) a title company because the premium that is charged on the title policy is split between the owner and the insuring agent. It's primarily a commission based business. The owners become an agent for a specific title insurance company. As an agent for that company, they share in the profits of what the title insurance sells for.

Title insurance is regulated by the Commonwealth of Pennsylvania, so therefore, regardless of what title insurance company you work with, the price of the policy remains the same. There are what's called a basic policy and an enhanced policy. At Pennsylvania First Settlement Services we sell on enhanced policy.

It's our opinion that an enhanced policy is much better than a basic policy and covers more as well as taking into account property appreciation, market value and the increased value the property has year to year.

The title company finds Realtors that want to work with them primarily because of their customer service. Customer service is something a Realtor looks for. A title company that provides good customer service to all of the people in the transaction typically is used more and more; thus more profits. It's called the book of business and you want your book of business to expand to as many Realtors as you can handle.

The title company owner employs an Escrow Officer(s), maybe a secretary or Receptionist that receives and opens the order and then they have a settlement agent or closer. Together, those people work as a team to move the transaction from opening to closing at the settlement table. Typically, Title Searchers are third party vendors and not employees of the title company. At least that's true in today's title company model.

Your Title Agent or Escrow Officer is the point of contact for all the parties in the transaction. The Title Agent or Escrow Officer is responsible for filing documents, verifying the legal description, collecting and disbursing all funds through the Settlement Agent, clearing all outstanding debts against the property and verifying all the pro-rates on the HUD. The Escrow Officer, at least at PA1st, will also coordinate property owners' insurance for the buyer.

Sometimes Realtors have an ownership interest in the title company and that's called an afBa. They own shares or membership interests in the title company. While that used to be a popular Pocono commodity in the past, it's not used that much in today's business. The Realtors simply want to be recognized for their loyalty through recognition at a party or things such as this. Realtors are not paid on a referral basis for each transaction that they bring to the title company. That is a violation of HUD.

Refinancing, or "Customer for Life" as they are called at Pennsylvania First Settlement Services are those customers that have closed their property with Pennsylvania First Settlement Services sometime in the past and now for some reason need additional title insurance because something has changed, either they have refinanced the property or they are making some small change in ownership which requires a re-issue rate. A re-issue rate is typically an insurance rate that's less than the sale price of an insurance policy because the work has primarily already been done.

Well, that's a little something about the title insurance business from all three angles. In the end, I think it's very exciting and hopefully you thought the same as well!
